How
to store the "terms of trade" on your computer: Terms of Trade General scope All deliveries and services of the Institute for Astrological Mathematics (hereafter called IAM) are subject to the binding legal terms set forth below ("Terms"). Scope of delivery and Services The IAM calculates and prepares calendars based on the concept of natural family planning using the so-called Lunar Phase Method. We refer to the exlusion of any guarantees and liabilities mentioned further down. We follow the calculation methods layed out by the advocates of the method, which has not been verified by us for its correctness, efficacy and scientific foundation. The calendars may be ordered by mail using a signed order form (see under "Beginning of contract"). The scope of delivery comprises: a calendar for contraception or child planning containing the marked individual lunar phases for one year beginning from either order month or one month after or from desired start date, print-out of computer calculation, if pre-selection of child's sex was desired additionally a calculation print-out of the corresponding days and entries in the calendar for those days, detailled instructions for using the calendar. Additional information by phone or email, please see under "Enquiries and phone service". The calendar may of course start with any desired month according to the client's wish. If a special start date is desired, then the client should check the appropiate box on the order form and specify the desired start date. Beginning of contract and calendar fees A legally binding contract is brought into existence between a client and IAM as soon as the IAM has received a completely filled-in and signed order form together with the pre-paid fee. The prepayment may be done in cash or by cheque drawable on a German bank. For the current fees for contraception and planning calendars please refer to the order form. The prices on the order form contain the VAT for Germany. The order form must contain the following data: name and address, date + time + location of birth, desired type of calendar, signature with date. Delivery costs There are no delivery costs.
Returns The client has the right to return the calendar, if through the IAM's fault the preparation of the calendar was based on incorrect data or any errors occurred in preparing the calendar. In this case the calendar will be calculated and created again correctly and sent to the client again. Alternatively the fee can be refunded. If incorrect birth data was entered in the order form there is no right to return the calendar. The Institute for Astrological Mathematics will undertake to provide calculations for clients on the strict understanding that this data is for educational and guide purposes only and is in no way to be considered as medical advice. The Institute for Astrological Mathematics does not offer or imply any guarantee of contraception, conception or successful pregnancy. Liability The IAM is not liable for improper application of a calendar or failure of the lunar phase method or the validity of the scientific research results on which the method is based. The IAM is also not liable for any consequences which might result from a possible incorrect calculation or preparing of a calendar. The IAM does not take responsibility for any consequences relating directly or indirectly to information supplied by them. Any questions of a medical nature should be referred to the applicant's own physician. Enquiries and phone service Before ordering you are welcome to enquire for additional information by email or phone. Also we can give further instructions by phone as to the proper technical usage of the calendars. The IAM is not offering any counselling related to medical or gynaecological topics. Privacy The client's personal data transferred to us will be stored electronically for being able to complete the service and are kept strictly private and will not be passed on to any other organisation or person.Miscellaneous This contract shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Although you acknowledge that we will have the ability to enforce our rights in any court of competent jurisdiction, you hereby consent to the exclusive jurisdiction and venue of courts in Frankfurt/Main, Germany, regarding any and all disputes relating to these Terms and any claims arising therefrom. These Terms as amended from time to time, set forth the entire understanding between the client and IAM and supersede any and all prior or contemporaneous agreements or understandings between you and IAM, whether oral or written, as to the subject matter of these Terms. If any provision of these Terms or the application thereof to any Member or circumstances shall to any extent be held to be invalid or unenforceable, the remainder of these Terms, or the application of such provisions to persons or circumstances as to which it is not held to be invalid or unenforceable, shall not be affected thereby, and each provision shall be valid and be enforced to the fullest extent permitted by law. No waiver of these Terms will be valid, except in the event that the waiver is in writing and signed by an authority of IAM. Christel Limpach-Bürkner |
